Web Site Design and Maintenance Agreement

Authorization:
The client is engaging Budget-WebDesign as an independent contractor for the specific project of designing a website or the design modification of his or her website and to post this website on the client's choice of a hosting service. The client hereby authorizes Budget-WebDesign to access this account, and authorizes the hosting service to provide us with full access to the client's website directory, cgi-bin directory, and any other directories or programs which need to be accessed for this project. The client also authorizes us to submit the completed website to search engines, directories and indexes.

Completion Date:
Budget-WebDesign and the client must work together to complete the website in a timely manner. We agree to work expeditiously to complete the website. The website cannot be completed until the required material is provided by the client.

Browser Compatibility:
Designing a website to fully work in multiple browsers (and browser versions) can require considerable, extra effort. It could also involve creating multiple versions of code/pages. Budget-WebDesign represents and warrants that the website we design for you will work in:
Microsoft® Internet Explorer versions 5 and up
Netscape Navigator/Communicator version 4 and up
We will make reasonable efforts to design a fully-functional web site, but our warrantee does not cover AOL, text-based browsers or requested special effects that we have advised you against.

Copyrights and Trademarks:
The client will assume all responsibility for any copyright violations due to material they have supplied to Budget-WebDesign.

Web Hosting:
The client understands that any web hosting services require a separate contract with a hosting company. Budget-WebDesign can provide this service for a nominal fee.

Legal Notice:
Budget-WebDesign cannot guarantee uninterrupted or error free operation of the website. But we will guarantee 100% functionality of the website itself. Budget-WebDesign recommends PayPal for internet commerce and is not responsible for any issues that may arise between PayPal and the client.

Payment of Fees:
Fees to Budget-WebDesign are due and payable on the following schedule: 50% upon signing this contract with final payment due upon website completion according to the clients' original specifications. Websites that cannot be completed within 8 weeks due to failure of client to provide materials (i.e. text content, images, etc.) will be subject to current rates. If the total amount of this contract is $250 or less, the total amount shall be paid upon signing this contract. In case the client has not secured Web space with a hosting service by the time the web pages are completed, the web pages may be delivered to the client on CD or attached to an e-mail letter. Advertising the pages to search engines and updating occur only after the final payment is made. All payments will be made in US funds.

Pricing quoted for website design expire 8 weeks after signing this agreement.

In order for Budget-WebDesign to remain in business, payments must be made promptly. Please pay on time. All fees are non-refundable. There will be a $10 late fee for any payments not received by the due date.

Maintenance of completed website:
This agreement includes minor website maintenance to regular web pages (not store product pages) over a one-month period starting at website design completion. This consists of updating links and making minor changes to a sentence or a paragraph. It does not include removing nearly all the text from a page and replacing it with new text. Budget-WebDesign is not responsible for any changes made to the website by the client or a third party representing the client. Additional maintenance to the website is available by the hour or by our optional maintenance plan.

By filling out following form and sending it to us with clicking the 'Agree button', the client accepts the terms of above Agreement between:
